Privacy Policy

This privacy policy (the “Policy”) formalizes our commitment to respecting the privacy of users of the eZtain.com website (the “Site”) operated by eZtain Lab SAS.

This Policy and the Site’s Terms and Conditions form a contractual whole. All capitalized terms not defined in this Policy are defined in the Terms and Conditions.

As part of providing our Site, we process your personal data in compliance with the General Data Protection Regulation 2016/679 of April 27, 2016 (“GDPR”) under the conditions described below.

Personal data means any information relating to an identified or identifiable natural person. We collect and process personal data exclusively in connection with providing our Services or communicating about these Services, strictly in compliance with the GDPR.

We collect only personal data that is adequate, relevant, and limited to what is necessary for the purposes for which it is processed. Therefore, you will never be asked to provide “sensitive” personal data such as racial or ethnic origin, political, philosophical, or religious opinions.
By registering on the Site, you authorize us to process your personal data in accordance with this Policy. If you do not accept the terms of this Policy, please refrain from using the Site and Services.

1. When do we collect your personal data and what data is collected?

We may collect and store your personal data, notably when you:

– place an order
– make an online payment
– contact us.

We use your personal data to enable the implementation and management of the Site’s Services and to respond to your specific requests. We also use your personal data to operate and improve our Services, our Site, and our approach. These data are used solely by us to better tailor our Services to your expectations.

If you have opted to receive emails and messages from us when creating your Account, you will receive electronic and alphanumeric messages about our products and promotions. You can unsubscribe from these communications at any time.

1.1 Site Navigation

Connection data. Each time you connect to our Site, we collect personal data such as your IP address and your computer’s MAC address, the date and time of connection, and information about the browser you use.
Navigation data. We also collect information that identifies how you access the Site, which pages you visit, and for how long. For this purpose, we may use cookies as described in section 5 below.

1.2 Account Creation

Access to certain Services requires prior creation of an Account. In accordance with the Terms and Conditions, you will be asked to provide certain personal data when creating your Account, including your first and last names, postal address, email address, and phone number.

1.3 Payment

Some of the available Services are paid. For this purpose, you agree that we may use external service providers who may collect personal data to enable the proper functioning of payment processing services by credit card or other means of payment and, if applicable, delivery of products or services.
To complete your purchase, you must provide your billing details as well as your payment information, including your credit card number, expiration date, security code, and cardholder name when paying by credit card.
You may also be asked to provide your telecom operator’s name, your mobile phone model, and a valid mobile phone number to enable purchase instructions to be sent directly through your mobile phone.
We retain your payment details and purchase records. Transaction details are stored either in our systems or by the external provider. This retention is performed for internal purposes, including accounting, compliance, and legal reasons, as detailed in section 5 of this Policy.

1.4 Newsletter Subscription

When creating your Account, you may give prior consent to receive our newsletters about news, new products, services, and promotions as part of the Services.
You can also consent directly to receive our newsletters by entering your email address at designated locations on the Site.
In any case, you have the right to withdraw your consent to receive such newsletters at any time and free of charge, under the conditions set out in section 6 of this Policy.

To respond to requests you may make to our Customer Service and to confirm information about you, we may use your first and last names, email address, and phone number.

2. How do we protect your personal data?

We have implemented technical and organizational security measures to ensure the security, integrity, and confidentiality of all your personal data, to prevent distortion, damage, or unauthorized access by third parties. We maintain an appropriate level of security considering current knowledge, implementation costs, and the nature, scope, context, and purposes of processing, as well as the risks and their likelihood.
However, since no security measure is infallible, we cannot guarantee absolute security of your personal data.
Furthermore, you are responsible for keeping your account password confidential. Do not share it with anyone. If you share your computer, remember to log out before leaving a Service.

3. When do we share your personal data?

3.1 Sharing your personal data with third parties

During your navigation on the Site, your personal data may be transmitted to external service providers. These third parties provide services on our behalf to enable the proper functioning of credit card payments and other Services.
No transfer of personal data is made outside the European Union.
Unless a third party requires you to accept its own privacy policy and terms of use, third parties who have received your personal data have committed to processing your personal data solely for the implementation of our Services.
We will never share your personal data with third parties for marketing and/or commercial purposes without obtaining your prior consent.

3.2 Sharing with Authorities

We may be required to disclose your personal data to administrative or judicial authorities when such disclosure is necessary to identify, apprehend, or prosecute any individual potentially harming our rights, those of any other user, or a third party. We may also be legally compelled to disclose your personal data and cannot oppose such disclosure.

4. How long do we retain your personal data?

We will retain your personal data only for the duration of your registration on the Site to ensure your identification when you log into your Account and to allow the provision of Services.
Thus, if you unsubscribe from the Site, your personal data will be deleted and only retained in archived form for the purpose of evidence of a right or contract.
In any case, we will retain your personal data for no longer than necessary for the purposes for which it is processed, in accordance with the uses described in this Policy and in compliance with applicable laws and regulations.

5. Cookies: how do we use them?

A cookie is a text file that may be stored on a device when accessing an online service using a browsing software. A cookie file enables its issuer, during its validity period, to recognize the device each time it accesses digital content containing cookies from the same issuer.
In any case, cookies stored on your browsing device with your consent are deleted 13 months after being stored.

5.2 What are the purposes of the cookies issued on our Site?

The cookies we issue allow us to:
– establish statistics and traffic volumes for the various parts of our Site (sections and visited content, navigation paths), allowing us to improve the interest and usability of the Site and, where applicable, our products and services;

6. What are your rights?

You are the only ones who have provided us with the personal data in our possession through the Site. You have rights concerning your personal data. In accordance with data protection regulations, notably Articles 15 to 22 of the GDPR, and after verifying your identity, you have the right to request access to your personal data, as well as the rectification or deletion of such data.
Furthermore, within the limits set by law, you also have the right to object to processing, to restrict it, to decide on the post-mortem fate of your data, to withdraw your consent at any time, and the right to data portability of the personal data provided.

7. Can we modify the Policy?

We reserve the right to modify the Policy at any time. Therefore, it is recommended that you consult it regularly. In case of changes, we will publish them on this page and in locations we deem appropriate depending on the nature and significance of the modifications.
Your continued use of the Site after any changes means you accept those changes. If you do not accept substantial changes to this Policy, you should stop using the Site.
